General terms of sale
Every order is accepted and processed according to these General Terms of Sale. Placing an order or accepting an offer implies full acceptance of these conditions, unless otherwise agreed in writing with Diamanti di Zucchero by Tortora Nicola. Where not otherwise specified, the provisions of the Italian Civil Code shall apply.
Goods, even if sold carriage paid, always travel at the buyer’s risk. The buyer must check the condition and quantity of the goods at delivery and immediately notify the carrier in writing of any issues, otherwise claims will not be accepted.
Delivery: goods are considered delivered ex works Diamanti di Zucchero by Tortora Nicola. Delivery times are indicative and not binding, as they may be affected by force majeure or unforeseen events. If the buyer does not collect the goods after notification of availability, the delivery shall be deemed completed, and storage costs may apply.
Prices: are expressed in euros and may vary depending on changes in production costs (raw materials, labor, transport). Shipping costs are calculated separately and indicated during checkout.
Food products and right of withdrawal
All products sold are artisanal food items, packaged in compliance with current health and safety regulations. For health protection reasons, according to art. 59 of the Italian Consumer Code, the right of withdrawal does not apply to food products once opened by the customer.
In case of defective or damaged goods, the customer must notify in writing within 8 days of receipt, attaching photographic proof. Replacement or refund may be arranged at the discretion of Diamanti di Zucchero.
Warranty and claims
All products are guaranteed for quality and compliance. Claims for defects must be submitted within 8 days of receipt (for evident defects) or discovery (for hidden defects). Goods cannot be returned without prior written authorization. In case of an authorized return, goods must be sent carriage paid within 8 days, and a minimum 15% handling fee may be applied.
Payments
Payments must be made according to the methods specified on the website at the time of purchase. In case of non-payment, Diamanti di Zucchero reserves the right to suspend supply and request immediate settlement.
Disputes and jurisdiction
For any dispute, the competent court is exclusively Naples, Italy. Contracts, even if made with foreign buyers, are governed by Italian law.
